HB 2099

The bill amends K.S.A. 12-16,138 to establish regulations regarding residential property inspections by cities and counties in Kansas. It prohibits local governments from adopting or enforcing ordinances that require periodic interior inspections of privately owned residential properties for code violations without the consent of the lawful occupant. However, this restriction does not apply to mixed-use properties or to inspections required by building permits. Additionally, it allows lawful occupants to request inspections at any time to check for code violations.


Furthermore, the bill permits cities or counties to mandate periodic inspections of residential properties when the owner is receiving governmental rental subsidies, with reasonable notice provided to tenants.
